Digital Goods: Our products are digital goods (such as overlays, brushes, and effects) delivered electronically. No physical shipment will be made for these purchases. Once your payment is processed, you will receive access to download the digital product.
Refunds & 30-Day Satisfaction Guarantee: We offer a 30-day satisfaction guarantee. If you are not fully satisfied with your purchase, you may request a refund by contacting us at info@smokeoverlay.com within 30 days of purchase. Refund requests will be reviewed on a case-by-case basis, and we reserve the right to approve or deny a refund request based on: the reason for dissatisfaction; whether the product has been accessed, downloaded, or used; and any previous refund history associated with the customer. If a refund is granted, you will receive a full refund. If the request is denied, we will provide a clear explanation.
Please note that under EU and UK consumer protection laws, digital products are generally non-refundable once accessed or downloaded. If you experience technical difficulties with a product, please contact us at info@smokeoverlay.com for support. If you purchased a product but have not yet downloaded or accessed it, you may be eligible for a refund within 14 days of purchase, in accordance with consumer rights in the EU and UK.
5. Accuracy of Billing and Account Information

The SmokeOverlay.com digital products are sold to you under a license, not sold to you outright. This means that when you purchase a digital product from us, you are granted a limited, non-exclusive, non-transferable license to use that product in accordance with these Terms, not an ownership of the intellectual property itself.
Permitted Use: Upon purchase, you are licensed to use our digital products for your own personal and professional use. This includes the right to use the overlays, brushes, and effects in your own projects, whether for yourself or for clients, including commercial projects such as client work, freelance projects, or creative works for sale. You may integrate our overlays/brushes/effects into original designs, images, videos, or other creative works that you produce. If you are delivering a project to a client that incorporates our product, you must ensure the final deliverable is in a non-editable format (for example, a flattened image or merged file) so that the original overlay/brush cannot be extracted by the client. You may install and store the purchased digital product on multiple devices you own, provided that the product is only accessed and used by you (the licensed user).
Prohibited Use: You agree not to engage in or permit any of the following uses of our products, as they are strictly prohibited:
- No Resale or Redistribution: You may not resell, redistribute, re-package, or share our digital products (or any modifications of them) with any other person or entity. This means you cannot sell, gift, lend, sublicense, or otherwise transfer the overlays, brushes, or effects to others, either for free or for profit. The license is single-user and non-transferable – it is only for your use.

For example, you cannot use our smoke overlay files to create a new overlay package, texture pack, or brush set and then sell or give that new product to others.
- No Providing Source Files to Clients: If you are using our products in a project for a client, you must not provide the client with the original overlay/brush/effect files as part of the deliverables. Any deliverable to a client should be in a flattened, non-editable form (such as a final image or video) where our product cannot be easily extracted or reused by the client. If your client needs to use the overlay or brush itself in other projects, they must purchase their own license from SmokeOverlay.com.
Any use of our digital products outside the scope of this license is a violation of our intellectual property rights and these Terms. Unauthorized reproduction, distribution, or exploitation of the products is strictly prohibited and may result in termination of your license and account, and in legal action under applicable copyright laws. We actively enforce our intellectual property rights; violators of these licensing terms may be subject to civil and/or criminal penalties under law. If you are unsure whether your intended use of our product is allowed, please contact us at info@smokeoverlay.com for clarification before proceeding.
9. Errors, Inaccuracies & Omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We welcome the presentation of our products in videos or public content — however, any direct or indirect redistribution or circumvention of the license is strictly prohibited.

3. Obecné podmínky
Vyhrazujeme si právo odmítnout službu komukoli, kdykoli a z jakéhokoli důvodu. Chápete, že váš obsah (kromě údajů o platební kartě) může být přenášen nešifrovaně přes různé sítě a upraven kvůli technickým požadavkům. Údaje o platebních kartách jsou při přenosu vždy šifrovány.
Souhlasíte s tím, že nebudete bez našeho písemného souhlasu kopírovat, prodávat ani zneužívat žádnou část služby či přístup k ní.
4. Digitální produkty a zásady vracení peněz
Digitální zboží: Naše produkty (overlays, štětce, efekty) jsou digitální a doručovány elektronicky. Fyzická zásilka není součástí. Po zpracování platby získáte přístup ke stažení produktu.
Vrácení a 30denní záruka spokojenosti: Nabízíme 30denní záruku spokojenosti. Pokud s nákupem nejste spokojeni, můžete do 30 dnů kontaktovat info@smokeoverlay.com a požádat o vrácení peněz. Žádosti posuzujeme individuálně a vyhrazujeme si právo je schválit nebo zamítnout podle důvodu nespokojenosti, toho, zda byl produkt stažen či použit, a předchozí historie vratek.
Pokud je žádost schválena, obdržíte plnou refundaci; v případě zamítnutí poskytneme jasné vysvětlení.
Upozorňujeme, že podle práva EU a Spojeného království nelze digitální obsah po jeho stažení obvykle vrátit. Pokud dojde k technickým problémům, napište nám. Pokud jste produkt ještě nestáhli, máte právo na vrácení do 14 dnů od nákupu.
5. Správnost fakturačních a uživatelských údajů
Souhlasíte, že při nákupu uvedete přesné a aktuální údaje. Jste odpovědní za jejich aktualizaci (včetně e-mailu a platebních údajů). Můžeme vám zpřístupnit nástroje třetích stran, nad nimiž nemáme kontrolu. Tyto nástroje poskytujeme „tak, jak jsou“, bez záruk. Používáte je na vlastní riziko a měli byste si prostudovat jejich vlastní podmínky.
Odkazy na weby třetích stran nejsou pod naší kontrolou a neneseme odpovědnost za jejich obsah ani služby. Stížnosti týkající se produktů třetích stran směřujte přímo jim.
8. Autorská práva a licence k digitálním produktům

Produkty SmokeOverlay.com jsou prodávány na základě licence, nikoli jako převod vlastnictví. Zakoupením získáváte omezenou, nevýhradní, nepřenosnou licenci k jejich používání.
Povolené použití:
Můžete produkty používat pro vlastní osobní i komerční projekty (včetně zakázek pro klienty), avšak v needitovatelné podobě (např. sloučený obrázek). Můžete je instalovat na více svých zařízení, pokud je používáte pouze vy.
Zakázané použití:
- Nesmíte produkty prodávat, darovat, půjčovat, sdílet nebo jinak distribuovat.
- Nesmíte je nahrávat veřejně (např. na weby, sociální sítě, GitHub apod.).
- Nesmíte si přivlastnit autorství nebo registrovat práva k produktu.

9. Chyby a nepřesnosti
